Chapter 7 bankruptcy is the most common type of bankruptcy filed in Utah. It is considered the “fresh start” bankruptcy because, unlike a Chapter 13, there is no repayment plan. Once your bankruptcy is discharged, all of the debt included in your bankruptcy will be wiped away, and you will have a “fresh start”.

Who can file a Chapter 7 bankruptcy?
In most cases, there are two scenarios that could make you ineligible to file a chapter 7:
1. You have received a bankruptcy discharge in the last 6-8 years (depends on the type of bankruptcy filed).
2. Based on your income, expenses, and debt burden you could feasibly complete a chapter 13 repayment plan.

How long will it take for a chapter 7 bankruptcy to take effect?
Over the years, we have worked with hundreds of people who are constantly being harassed by their creditors. One important question that comes up over and over again is how long will it take for the bankruptcy to take effect, and the harassment to end.
This happens IMMEDIATELY. As soon as a chapter 7 bankruptcy is filed, an “Order for Relief” goes into effect. This order is more commonly referred to as “the automatic stay”. This order is important because it immediately stops your creditors from harassing you. This includes any attempt to garnish your wages, foreclosures, repossessions, lawsuits, and every other attempt to collect debt from you. This will provide you with temporary relief, allowing for the bankruptcy process to take place.
How soon can you file?
