Alimony

Alimony is also commonly known as “spousal support”. After a divorce, it is common for a spouse that earns substantially more than another spouse to pay alimony.

How is alimony calculated?

Determining the amount that the supportive spouse will be required to pay in alimony is very difficult. The court looks at multiple factors and uses a very sophisticated formula to come up with an exact number. The following are some of the factors the court uses:

  • Reason for terminating the marriage
  • Marriage length
  • Financial needs of each spouse
  • Earning history and potential for each spouse
  • Education of each spouse
  • Age and current health condition of each spouse
  • % custody of each spouse
  • Contributions to the marriage by each spouse

 

Financial information

As you can imagine, the court will want to have specific information regarding your finances when determining alimony. Financial declarations are required from each party and will be made under oath. The court will require the following to be submitted as part of your financial declaration:

  • Most recent 2 years of tax returns
  • 12 months of pay stubs, along with any additional income
  • Estimated value of real estate; could be an appraisal or tax notice
  • Bank account statements
  • Proof of living expenses (bills, loans, etc)
